General Terms and Conditions (GTC)

 

 

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts concluded via the Date and website between Date and (hereinafter referred to as the "Provider") and participants of the events (hereinafter referred to as "Participants").

 

2. Subject of the Contract

2.1. The Provider offers Participants the opportunity to purchase access to various single events through the Date and website.

2.2. Specific details about the individual single events, including date, location, and price, are listed on the website.

 

3. Conclusion of Contract

3.1. By clicking the purchase button, the Participant submits a binding order for the events in the shopping cart. The contract is concluded once the Provider has received all necessary details from the Participant and accepts the order by sending an order confirmation via email.

3.2. Booking a spot at the events is only permitted for Participants who are at least 18 years old. By booking, the Participant confirms that they have reached the minimum age. The exact age group for each event is specified in the event details and must be adhered to.

 

4. Prices and Payment Terms

4.1. All prices are listed in Swiss Francs (CHF) and include statutory VAT.

4.2. Payment can be made via credit card, PayPal, TWINT, or other payment methods offered on the website.

4.3. The purchase price is due immediately upon conclusion of the contract.

 

5. Cancellation

5.1. The Participant has the right to receive a full refund of the purchase price if they cancel a booked event within the following deadlines. If the cancellation is made outside these deadlines, there is no entitlement to a refund.

Cancellations must be submitted in writing via email.

5.1.1. Event "Date and Cheers": no later than 48 hours before the event begins

5.1.2. Event "Date and Hike": no later than 48 hours before the event begins

5.1.3. Event "Date and Games": no later than 48 hours before the event begins

5.1.4. Event "Date and Sports": no later than 48 hours before the event begins

5.1.5. Event "Date and Wine": no later than 96 hours before the event begins

5.1.6. Event "Date and Dine": no later than 8 days before the event begins

5.2. If an event is canceled by the Provider, the Participant will be informed immediately via email. In this case, the Participant will receive a full refund of the purchase price.

 

6. Event Procedures

6.1. Upon receiving the booking, a confirmation email will be sent to the Participant.

6.2. No later than one day before the event, all Participants will receive the exact schedule and agenda of the event via email.

6.3. During the event, spot checks of the confirmation emails from Date and may be conducted.

 

7. Photo and Video Recordings at Events

7.1. During events organized by the Provider, photos and videos of Participants may be taken by influencers or designated individuals. By booking the event, the Participant expressly agrees that these recordings may be published on the Provider's social media channels and other platforms.

If a Participant does not wish to appear in the recordings, they are required to inform the individual taking the recordings (e.g., influencer or photographer) directly and clearly. The Provider is not responsible for the publication of recordings if no explicit request not to be photographed or filmed has been made.

 

8. Non-Transferability of Event Participation and Misuse

8.1. Non-Transferability: Event booking confirmations are personalized and non-transferable. Each Participant is responsible for ensuring their data is correct, using the booking confirmations themselves, and not sharing them with third parties. The Provider reserves the right to exclude Participants from future single events if it becomes known that they brought friends, acquaintances, or others to an event without them having booked and paid for their participation separately. Refunds for future event participation fees will not be granted in such cases.

8.2. Misuse: Any unauthorized transfer or sharing of booking confirmations constitutes misuse and a breach of contract. In cases of misuse, we reserve the right to cancel the ticket without refund and deny access to the event.

8.3. Legal Consequences: We reserve the right to take legal action and claim damages in the event of misuse. Misuse may result in civil legal consequences, including but not limited to claims for damages.

 

9. Inappropriate Behavior and Consequences

9.1. The Provider reserves the right to exclude Participants from future events if complaints about inappropriate behavior during a previous event are received. The assessment of such behavior is at the sole discretion of the Provider. Refunds for future event participation fees will not be granted in such cases.

 

10. Liability

10.1. Participation in events is at the Participant's own risk. The Provider accepts no liability.

10.2. The Provider is not responsible for the accuracy, completeness, or timeliness of the information provided about the events.

10.3. The Provider assumes no liability for the execution, quality, or content of the events offered. The operators of the event locations are solely responsible for the proper execution and content of the events.

 

11. Satisfaction Guarantee

11.1. We want our participants to be completely satisfied with our events. Therefore, we offer a satisfaction guarantee: If a participant is dissatisfied with the booked event, we will refund the full ticket price. A prerequisite for the refund is the submission of a reasonable and comprehensible reason within 48 hours after the event. The decision regarding the refund is at the discretion of the organizer. There is no entitlement to a refund in cases of no-show or cancellation by the participant.

 

12. Data Protection

12.1. The Provider is committed to protecting the Participants' personal data in accordance with Swiss data protection laws.

12.2. The Provider’s privacy policy, available on the website, explains the nature, scope, and purpose of data collection and use.

12.3. Participants agree that their full names and email addresses may be shared with third-party providers or partners of the Provider. This is solely for the purpose of preventing misuse and ensuring the integrity and security of our services. We commit to using the shared data only as necessary and carefully selecting third-party providers or partners to ensure data protection.

 

13. Final Provisions

13.1. Contracts between the Provider and Participants are governed by Swiss law.

13.2. The place of jurisdiction for all disputes arising from contractual relationships between the Participant and the Provider is the location of the Provider’s headquarters.

 

14. Severability Clause

14.1. Should any provision of these GTC be invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid or unenforceable provision, a regulation shall apply that comes as close as possible to the economic purpose of the invalid provision. The same applies to any gaps in the provisions.
