General Terms and Conditions (GTC)

 

for the use of the Date and memberships (One, Two, Three)

 

1. Scope

1.1 These General Terms and Conditions (GTC) apply to all contracts between Date and GmbH, Baar/ZG (Switzerland), hereinafter referred to as "Provider", and individuals who purchase memberships or services through the website dateand.com, hereinafter referred to as "Members".

1.2 By concluding a membership, the member accepts these terms and conditions in their currently valid version.

 

2. Subject of the contract

2.1 The provider offers various memberships (One, Two, Three) that allow access to regularly held offline single meetings ("meetings", "appointments" or "formats").

2.2 Each membership includes a monthly contingent of credits that can be redeemed for appointments. The number of credits and the allocation to the formats (Pathways, Brunch, Stories, DeepTalk, Wine) is derived from the current service description on the website.

2.3 Memberships are valid for fixed defined periods (1, 3, or 6 months) and end automatically at the end of this time. There is no automatic extension.

 

3. Conclusion of Contract

3.1 By clicking the purchase button, the member makes a binding booking. The member confirms with the booking that they are at least 18 years old. A contract is concluded as soon as the provider confirms the order by email.

3.2 Memberships can only be booked by persons aged 18 and over.

3.3 Some formats are aimed at defined age groups (e.g., 30–38 or 35–43). The member commits to only booking formats that correspond to their age group.

 

4. Prices and Payment

4.1 All prices are stated in local currency (CHF or EUR) and include – if applicable – the statutory value-added tax.

4.2 Payment is made via the payment methods offered on the website (e.g., credit card, PayPal, TWINT).

4.3 The entire term of the membership is paid in advance. Monthly deductions do not take place.

 

5. Term, cancellation, and automatic termination

5.1 Memberships have a fixed term of 1, 3, or 6 months – depending on the chosen model.

5.2 During the contract term, ordinary cancellation is excluded.

This represents the minimum term.

5.3 The membership ends automatically at the end of the chosen term – without the need for cancellation.

5.4 There is no automatic extension. If the member wishes to extend, they can book a new membership.

 

6. Credits and participation in meetings

6.1 Each format requires a specific number of credits. The allocation is derived from the service description on the website.

6.2a Cancellation by the member

If a member has registered for an appointment (via the notes field in the booking process or via a separate email) and cancels the appointment at least 48 hours before it starts, the credits used for this will be fully refunded. These credits can be used again within the ongoing membership. If the cancellation occurs less than 48 hours before the start, the credits will expire without compensation.

6.2b Random checks during appointments

During an appointment, the provider is entitled to randomly request the booking confirmation emails to verify eligibility to participate.

6.3 Cancellation by the provider

If an appointment is canceled by the provider, members will automatically receive the credits used for it.

These credits can be used:

                 during the remaining term of membership

                 plus an additional 90 days after the term expires

After this period, the credited credits will expire without compensation if members do not use them to participate in appointments.

If a replacement appointment organized by the provider is also canceled, the relevant credits will be refunded.

 

7. Right of Withdrawal

7.1 Uniform right of withdrawal for Germany & Switzerland

The provider grants all members – regardless of residence – a right of withdrawal of 14 days from the conclusion of the contract.

7.2 Expiration of the right of withdrawal

The right of withdrawal expires either 14 days after the conclusion of the contract or as soon as the member books an appointment and does not cancel it at least 48 hours before the start – depending on which occurs first.

 

8. Behavior and exclusion

8.1 Inappropriate behavior

The provider may exclude members from all future appointments with immediate effect if their behavior towards other members or the provider is deemed inappropriate, crossing boundaries, disrespectful, aggressive, or disruptive.

This also applies to behavior prior to the meetings (e.g., via email or message). 

The assessment is made at the provider's careful discretion.

In this case, the member loses all unused credits. There is no right to a refund.

 

9. Photo and video recordings

9.1 Use for marketing

At the meetings, photo and video recordings may be made, which the provider may use for the following purposes:

                 Website

                 Social Media (Instagram, Facebook, TikTok, YouTube etc.)

                 Newsletter

9.2 Revocation of consent on-site

Anyone who does not wish to be recorded must inform the person taking photographs/filming directly and clearly on-site.

9.3 Disclaimer of liability

The provider assumes no liability for recordings if a member has not made a notification on-site.

 

10. Non-transferability

10.1 Memberships are personal

Memberships, credits, and participation spots are not transferable.

10.2 Abuse

In case of transfer or attempted transfer, the provider may:

                 suspend the membership

                 delete all credits

                 initiate legal action

No refunds will be issued.

 

11. Liability

11.1 Participation in all appointments is at one's own risk.

11.2 The provider assumes no liability for damages incurred during or as a result of participation in meetings.

11.3 The provider is not liable for the accuracy, completeness, or timeliness of the information provided regarding the appointments.

11.4 The provider assumes no liability for the execution, quality, or content of the offered appointments. The operators of the respective locations are solely responsible for the proper execution of the appointments.

11.5 External Locations / House Rules

For formats conducted in cooperation with external partners (e.g., cafés, bars, tasting providers), the respective house rules of the partner also apply. Members commit to comply with these. The provider is not liable for actions or omissions of the partners.

11.6 Personal Belongings

The provider is not liable for loss, damage, or theft of personal belongings of the members – neither during a meeting nor on the way to or from it.

 

12. Data protection

12.1 The processing of personal data is carried out in accordance with the privacy policy available on the website.

12.2 Disclosure of Names to Partners

The member agrees that their name may be transmitted in the form 'First name + first letter of last name' to partners of the provider (e.g., cafés, bars, tasting providers) as far as this is necessary for the creation of guest lists, access control, or to prevent abuse.

 

13. Final Provisions

13.1 Swiss law applies.

13.2 The place of jurisdiction is the registered office of the provider (Baar/ZG).

13.3 Should any provision of these GTC be ineffective, the remaining provisions shall remain unaffected. This also applies if individual provisions are only partially ineffective.

13.4 No Subsequent Changes to Services

The provider reserves the right to make minor adjustments to formats, content, or locations, provided that the overall character of the service is maintained and the member does not incur any significant disadvantages.

13.5 Electronic Communication

The member agrees that all contract-relevant information (bookings, changes, credits, cancellations) will be transmitted electronically.
